U-Visa

Discover protection and justice through expert legal assistance in your U-Visa pursuit.

The U-Visa offers a temporary immigration status to eligible crime victims, which grants them a range of benefits, including the right to live and work in the United States. It provides a crucial lifeline to individuals who have experienced severe physical or emotional trauma due to criminal activities, including domestic violence, sexual assault, human trafficking, and other serious crimes. U-Visa recipients can also include their qualifying family members in their application, enabling them to obtain U-Visa derivative status.

To be eligible for a U-Visa, individuals must meet several key criteria:

1. Victim of Qualifying Criminal Activity:

  • The applicant must have been a victim of a qualifying criminal activity. These crimes often include, but are not limited to, domestic violence, sexual assault, human trafficking, kidnapping, and certain other offenses.

2. Suffered Substantial Harm:

  • The victim must have experienced substantial mental or physical abuse as a result of the criminal activity.

3. Assistance to Law Enforcement:

  • The applicant must have been, is currently, or will likely be helpful to law enforcement or government officials in the investigation or prosecution of the crime. This usually involves providing information  cooperating with law enforcement agencies, or testifying in court.

4. Certification from a Law Enforcement Agency:

  • A law enforcement agency, prosecutor, or other authority responsible for the investigation or prosecution of the crime must certify the applicant's helpfulness in the case.

5. Admissibility:

  • The applicant must meet admissibility requirements, or they must be eligible for a waiver of any grounds of inadmissibility.
